  1. User Conduct

3.1 Prohibited Conduct. You agree not to use the Platform to:

(a) harass, abuse, or threaten others;

(b) upload or transmit any content that is harmful, offensive, obscene, defamatory, or otherwise objectionable;

(c) violate the privacy or publicity rights of others;

(d) engage in any activity that interferes with or disrupts the Platform or the servers and networks that support the Platform;

(e) impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity;

(f) use the Platform to engage in any illegal activity, or to solicit the performance of any illegal activity; or

(g) assist any third party in engaging in any activity prohibited by these Terms.

3.2 Monitoring. CurePedia has the right, but not the obligation, to monitor any user activity and user-generated content on the Platform. We may remove any such content or activity at any time for any reason (including, but not limited to, upon receipt of claims or allegations from third parties or authorities relating to such content or activity), or for no reason at all.

  1. Intellectual Property

4.1 Ownership. The Platform, including all content, features, and functionality, is owned by CurePedia or its licensors and is protected by Indian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

4.2 License. Subject to these Terms, CurePedia grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Platform for personal, non-commercial use only.

4.3 Restrictions. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Platform, except as follows:

(a) Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.

(b) You may store files that are automatically cached by your Web browser for display enhancement purposes.

(c) You may print or download one copy of a reasonable number of pages of the Platform for your own personal, non-commercial use and not for further reproduction, publication, or distribution.

4.4 Trademarks. The CurePedia name and logo are trademarks of CurePedia or its affiliates. You must not use such marks without the prior written permission of CurePedia.

5.1 Platform “AS IS”. The Platform is provided “AS IS” and without warranties of any kind, either express or implied. CurePedia disclaims all warranties, express or implied, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

5.2 No Guarantee. CurePedia does not guarantee that the Platform will be uninterrupted or error-free, that defects will be corrected, or that the Platform or the server that makes it available are free of viruses or other harmful components.

  1. Limitation of Liability

6.1 Exclusion of Damages. In no event shall CurePedia or its affiliates be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the Platform, even if CurePedia has been notified orally or in writing of the possibility of such damage.

6.2 Limitation of Liability. In no event shall CurePedia or its affiliates be liable for any indirect, special, incidental, consequential, or punitive damages arising out of or related to the use or inability to use the Platform, whether based on contract, tort, negligence, strict liability, or otherwise.

  1. Indemnification

You agree to indemnify and hold CurePedia and its affiliates, officers, agents, employees, and partners harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of the Platform, your violation of these Terms, or your violation of any rights of another.

  1. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or related to these Terms shall be resolved by binding arbitration in accordance with the Arbitration and Conciliation Act, 1996, and the award rendered by the arbitrator(s) shall be final and binding on the parties.

  1. Termination

CurePedia may terminate these Terms at any time without notice or liability. Upon termination, you must immediately cease all use of the Platform.

  1. Modification

CurePedia may modify these Terms at any time by posting the modified Terms on the Platform. Your continued use of the Platform after any such changes constitutes your acceptance of the modified Terms.

  1. Entire Agreement

These Terms constitute the entire agreement between you and CurePedia regarding the use of the Platform and supersede all prior or contemporaneous communications, whether electronic, oral, or written, between you and CurePedia.
